Ceci afin de trouver une solution de mani\u00e8re informelle.<\/p>\n\n\n\n<p>Jusqu\u2019ici la pr\u00e9sence d\u2019une personne de confiance \u00e9tait conseill\u00e9e mais non obligatoire.&nbsp; Une nouvelle proposition de loi veut rendre obligatoire la d\u00e9signation d\u2019une personne de confiance, sous certaines conditions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><u>Valeur ajout\u00e9e de la personne de confiance<\/u><\/h2>\n\n\n\n<p>La personne de confiance a un r\u00f4le important dans la pr\u00e9vention et la prise en charge des <a href=\"https:\/\/www.kazuki.eu\/prevention-sante-securite-bien-etre\/\">risques psychosociaux<\/a>.&nbsp; Dans les organisations, cette derni\u00e8re est tenue au devoir de confidentialit\u00e9 afin qu\u2019on puisse se confier \u00e0 elle sans crainte.&nbsp; Elle est le premier contact du travailleur pour signaler un comportement ind\u00e9sirable au travail.&nbsp; Elle peut intervenir en amont de l\u2019aggravation d\u2019un conflit afin de d\u00e9samorcer la situation et agir rapidement.&nbsp; Cette derni\u00e8re peut \u00e9galement avoir un impact sur les diff\u00e9rents acteurs de la pr\u00e9vention comme le Comit\u00e9 pour la Pr\u00e9vention et la Protection au Travail, le Conseiller en Pr\u00e9vention Aspects Psychosociaux, le Conseiller en Pr\u00e9vention\u2026 tout en respectant son devoir de r\u00e9serve.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><u>O\u00f9 en sommes-nous<\/u>&nbsp;?<\/h2>\n\n\n\n<p>Actuellement, la d\u00e9signation d\u2019une personne de confiance \u00e9tait une recommandation, l\u2019employeur est donc libre de d\u00e9signer une personne de confiance sauf si la repr\u00e9sentation des travailleurs en fait la demande (que ce soit au Comit\u00e9 ou via la d\u00e9l\u00e9gation syndicale).<\/p>\n\n\n\n<p>L\u2019employeur et les travailleurs doivent en outre se mettre d\u2019accord sur la d\u00e9signation de la personne de confiance.&nbsp; L\u2019approbation des travailleurs est donc requise.<\/p>\n\n\n\n<p>Le projet de loi a \u00e9t\u00e9 d\u00e9pos\u00e9 par le ministre du Travail,<a href=\"https:\/\/news.belgium.be\/fr\/dispositions-diverses-relatives-au-travail-0\"> Pierre-Yves Dermagne<\/a>, et a re\u00e7u l\u2019approbation du Conseil f\u00e9d\u00e9ral des ministres en date du 16\/06\/2023.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><u>Nouvelle proposition de loi <\/u><\/h2>\n\n\n\n<p>Une proposition de loi rend obligatoire la d\u00e9signation d\u2019une personne de confiance sauf si l\u2019entreprise occupe moins de 50 travailleurs.&nbsp; Mais la r\u00e8gle suivant laquelle la personne de confiance peut \u00eatre d\u00e9sign\u00e9e si la d\u00e9l\u00e9gation des travailleurs en fait la demande reste d\u2019actualit\u00e9.<\/p>\n\n\n\n<p>La publication n\u2019a pas encore \u00e9t\u00e9 effectu\u00e9e.&nbsp; En effet, le Conseil Sup\u00e9rieur doit donner son avis sur le projet de loi et ce dernier sera publi\u00e9 sous une forme modifi\u00e9e ou non apr\u00e8s son approbation par le Parlement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><u>R\u00e9sum\u00e9 de la proposition de loi<\/u><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les entreprises de 50 travailleurs ou plus devront toujours disposer d\u2019au moins une personne de confiance.<\/li>\n\n\n\n<li>Les entreprises de 20 travailleurs ou plus, qui font appel \u00e0 un CPAP (conseiller en pr\u00e9vention aspects psychosociaux) via leur SEPPT (service externe de pr\u00e9vention et de protection au travail) et qui d\u00e9signe une personne de confiance, cette personne de confiance fera partie du personnel interne de l\u2019organisation.<\/li>\n\n\n\n<li>Les entreprises de moins de 50 travailleurs disposeront d\u2019une personne de confiance si la d\u00e9l\u00e9gation des travailleurs en fait la demande.<\/li>\n\n\n\n<li>Dans les structures o\u00f9 aucune personne de confiance n\u2019a \u00e9t\u00e9 d\u00e9sign\u00e9e avec moins de 50 travailleurs, le conseiller en pr\u00e9vention du service interne de pr\u00e9vention et de protection au travail pourra exercer les missions de la personne de confiance sauf dans les organisations de moins de 20 travailleurs o\u00f9 la fonction de conseiller en pr\u00e9vention est exerc\u00e9e par l\u2019employeur en personne.<\/li>\n<\/ul>\n\n\n\n<p>&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><u>Le saviez-vous<\/u>&nbsp;?<\/h2>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-b2819749 alignfull uagb-is-root-container\"><div class=\"uagb-container-inner-blocks-wrap\">\n<div class=\"wp-block-uagb-container uagb-block-0c09b03b\">\n<p>Vous avez <strong>moins de 20 travailleurs\u00a0<\/strong>: Les employeurs peuvent d\u00e9signer comme personne de confiance un membre du personnel ou une personne externe \u00e0 l\u2019entreprise ou \u00e0 l\u2019institution. Lorsque le conseiller en pr\u00e9vention aspects psychosociaux fait partie d\u2019un service externe pour la pr\u00e9vention et la protection au travail, au moins une des personnes de confiance devra obligatoirement faire partie du personnel de l\u2019entreprise (sauf si l\u2019employeur occupe moins de 20 travailleurs).<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container externe afin de superviser votre personne de confiance ou offrir \u00e0 votre personnel l\u2019opportunit\u00e9 du choix de se confier soit \u00e0 la personne de confiance interne ou externe.<\/p>\n\n\n\n<p>D\u2019exp\u00e9rience, la formule est efficace car bien que la connaissance de l\u2019entreprise et du personnel soit consid\u00e9r\u00e9e comme des avantages de la personne de confiance interne, d\u2019autres estiment plus compliqu\u00e9 de se confier \u00e0 une personne interne et se sentent plus en s\u00e9curit\u00e9 avec une personne externe offrant \u00e0 leurs yeux une plus forte garantie de confidentialit\u00e9, de prise de recul, de non-jugement et \u00e9quit\u00e9 entre les parties.<\/p>\n\n\n\n<p>De r\u00e9cents \u00e9changes m\u2019ont permis de noter que les membres du personnel parfois pr\u00e9f\u00e8rent garder le silence m\u00eame si une personne de confiance interne existe et ce en pr\u00e9sence d\u2019un r\u00e9el mal-\u00eatre croissant.<\/p>\n\n\n\n<p>Pour rappel&nbsp;: A charge de l\u2019employeur de prendre les mesures adapt\u00e9es afin de r\u00e9pondre aux besoins r\u00e9els des membres du personnel en termes de <a href=\"https:\/\/www.kazuki.eu\/prevention-sante-securite-bien-etre\/\">Protection de la sant\u00e9 et de la s\u00e9curit\u00e9<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><u>Formation obligatoire pour les personnes de confiance<\/u><\/h2>\n\n\n\n<p>La personne d\u00e9sign\u00e9e comme personne de confiance est tenu de suivre une formation de 5 journ\u00e9es r\u00e9pondant aux exigences l\u00e9gales en termes de contenu.&nbsp;<\/p>\n\n\n\n<p>Il est \u00e9galement pr\u00e9vu par la loi qu\u2019une session de recyclage annuel d\u2019une journ\u00e9e ou une demi-journ\u00e9e est \u00e0 programmer, il s\u2019agit d\u2019\u00e9change de cas pratique avec d\u2019autres personnes de confiance.&nbsp;<\/p>\n\n\n\n<p>Outre mes interventions en tant que recruteur, superviseure, je donne \u00e9galement la <a href=\"https:\/\/maison-formation-wapi.be\/formations\/personne-de-confiance-formation-de-base\/\">formation de base (aupr\u00e8s de notre partenaire La Maison de la Formation)<\/a> r\u00e9pondant aux prescrits l\u00e9gaux, pour les personnes de confiance afin de leur fournir les connaissances et les comp\u00e9tences pour accueillir et accompagner un salari\u00e9
