{"id":11514,"date":"2022-03-28T11:50:41","date_gmt":"2022-03-28T09:50:41","guid":{"rendered":"https:\/\/www.kazuki.eu\/?p=11514"},"modified":"2024-07-17T13:49:50","modified_gmt":"2024-07-17T11:49:50","slug":"cle-droit-deconnexion-belgique","status":"publish","type":"post","link":"https:\/\/www.kazuki.eu\/consulting\/2022\/03\/28\/cle-droit-deconnexion-belgique\/","title":{"rendered":"Cl\u00e9 4 : Droit \u00e0 la d\u00e9connexion au travail"},"content":{"rendered":"<p>Le droit \u00e0 la d\u00e9connexion au travail n\u2019est en fait devenu un droit en Belgique que depuis le 01\/02\/2022 par une nouvelle l\u00e9gislation prot\u00e9geant la vie priv\u00e9e des fonctionnaires.<\/p>\n<p>En effet, en vertu de la nouvelle l\u00e9gislation pr\u00e9vue afin de prot\u00e9ger les travailleurs du surmenage et du <a href=\"https:\/\/www.kazuki.eu\/consulting\/bien-etre-de-lentreprise\/\" target=\"_blank\" rel=\"noopener\">burn-out<\/a>, les fonctionnaires belges ont le droit d\u2019ignorer les appels de leur hi\u00e9rarchie en dehors des heures de travail (sauf urgence ou circonstances exceptionnelles).<\/p>\n<p>Encore faut-il d\u00e9terminer ce qui est entendu par urgence ou circonstances exceptionnelles\u00a0? Mais la ministre belge de la Fonction publique et des Entreprises publiques, Petra De Sutter a pr\u00e9cis\u00e9 je cite\u00a0: \u00ab\u00a0\u2026 ne subiront aucun d\u00e9savantage s\u2019ils ne r\u00e9pondent pas au t\u00e9l\u00e9phone ou ne lisent pas les messages li\u00e9s \u00e0 leur travail en dehors des heures de travail normales\u2026\u00a0\u00bb.<\/p>\n<p>Cette derni\u00e8re estime qu\u2019il est n\u00e9cessaire de prendre des mesures en ce sens pour prot\u00e9ger les fonctionnaires de <a href=\"https:\/\/www.kazuki.eu\/consulting\/politique-de-bien-etre\/\" target=\"_blank\" rel=\"noopener\">stress excessif<\/a> et de risque de burn-out.\u00a0 Dans le contexte actuel de croissance du t\u00e9l\u00e9travail, le burn-out est devenu une pr\u00e9occupation centrale puisque les salari\u00e9s ont tendance \u00e0 passer plus de temps sur l\u2019ordinateur et lire les e-mails professionnels sur leur smartphone.<\/p>\n<p>Bien qu\u2019il ne s\u2019agisse ici que des fonctionnaires, les nouvelles r\u00e8gles relatives \u00e0 ce droit \u00e0 la d\u00e9connexion devraient s\u2019\u00e9tendre au secteur priv\u00e9 par la suite.<\/p>\n<p>De son c\u00f4t\u00e9, le Parlement europ\u00e9en planche \u00e9galement sur une nouvelle l\u00e9gislation en mati\u00e8re de droit \u00e0 la d\u00e9connexion.\u00a0 Affaire \u00e0 suivre\u2026<\/p>\n<p><a href=\"https:\/\/www.eurofound.europa.eu\/observatories\/eurwork\/industrial-relations-dictionary\/right-to-disconnect\">https:\/\/www.eurofound.europa.eu\/observatories\/eurwork\/industrial-relations-dictionary\/right-to-disconnect<\/a><\/p>\n<h2><strong>Le travail de 4 jours par semaine\u00a0?<\/strong><\/h2>\n<p>Outre le droit \u00e0 la d\u00e9connexion, la Belgique envisagerait de passer \u00e0 la semaine de quatre jours de travail et une r\u00e9forme plus vaste du droit du travail serait donc envisag\u00e9e.<\/p>\n<p><a href=\"https:\/\/www.politico.eu\/article\/belgium-four-day-week-labor-market\/\">https:\/\/www.politico.eu\/article\/belgium-four-day-week-labor-market\/<\/a><\/p>\n<p>Suivant l\u2019article dont le lien ci-dessus, le week-end serait prolong\u00e9 d\u2019un jour suppl\u00e9mentaire mais le m\u00eame nombre d\u2019heures par semaine serait maintenu.\u00a0 Cette mesure ne serait pas obligatoire dans le chef du salari\u00e9 mais ne serait applicable que pour les Belges travaillant entre 38 et 40 heures par semaine.<\/p>\n<h2><strong>D\u00e9connexion digitale<\/strong><\/h2>\n<p>Bien que le droit \u00e0 la d\u00e9connexion \u00ab\u00a0totale\u00a0\u00bb n\u2019ai pas son texte l\u00e9gal, un texte de loi datant de 2018 existe, toutefois, concernant la d\u00e9connexion digitale.\u00a0 En effet, la section 2 du chapitre 2 de la loi traite de la concertation sur la d\u00e9connexion et l\u2019utilisation des moyens de communication num\u00e9riques.\u00a0 L\u2019employeur organise donc au sein du CPPT une concertation sur le sujet de la d\u00e9connexion du travail et l\u2019utilisation des moyens de communication num\u00e9riques.\u00a0 Ceci afin de respecter les temps de repas, vacances, et autres cong\u00e9s en vue de l\u2019\u00e9quilibre vie priv\u00e9e et vie professionnelle.<\/p>\n<p>Moniteur belge \u2013 Loi du 26 mars 2018\u00a0: <a href=\"https:\/\/www.ejustice.just.fgov.be\/cgi\/article_body.pl?language=fr&amp;pub_date=2018-03-30&amp;numac=2018011490&amp;caller=summary\">https:\/\/www.ejustice.just.fgov.be\/cgi\/article_body.pl?language=fr&amp;pub_date=2018-03-30&amp;numac=2018011490&amp;caller=summary<\/a><\/p>\n<h2><strong>Intelligence num\u00e9rique ou digitale<\/strong><\/h2>\n<p>Quant nous connaissons le principe addictif li\u00e9 aux smartphones, tablettes, \u00e9crans en tous genre, la solution ne serait-elle pas le d\u00e9veloppement conscient de notre intelligence num\u00e9rique\u00a0?\u00a0 Comment je fonctionne face \u00e0 mon smartphone\u00a0?\u00a0 Puis-je m\u2019en passer\u00a0? Combien de temps\u00a0?\u00a0 Le manque se fait-il sentir\u00a0? \u2026<\/p>\n<p>L\u2019autonomie dont nous parlions dans l\u2019article pr\u00e9c\u00e9dent entre ici en ligne de compte \u00e0 nouveau\u00a0: faut-il contr\u00f4ler le nombre d\u2019heures de connexion ou faire confiance\u00a0?\u00a0 Et si le salari\u00e9 \u00e9tait plus productif suivant son profil en soir\u00e9e plut\u00f4t qu\u2019en matin\u00e9e\u00a0? Doit-on l\u2019obliger \u00e0 suivre l\u2019horaire ou au contraire faire preuve de flexibilit\u00e9 et lui laisser le loisir de r\u00e9aliser la t\u00e2che quand bon lui semble (pour autant que cela ne n\u00e9cessite pas de contact durant les heures de travail avec des collaborateurs)\u00a0?\u00a0 Un fonctionnement \u00e0 l\u2019atteinte de l\u2019objectif plut\u00f4t qu\u2019un contr\u00f4le en
